Title IX Prohibition of Sex-Based Discrimination, Sexual Harassment and Retaliation

No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any educational program or activity receiving federal financial assistance.” – 20 U.S.C. § 1681 & 34 C.F.R. Part 106 (1972). Title IX prohibits discrimination, harassment and retaliation on the basis of sex in any federally-funded education program or activity and is such misconduct is prohibited by the University. See University Policy 154. Any complaint received on or after August 14, 2020 will be reviewed and handled in accordance with this policy and the procedures implemented August 14, 2020.

With respect to sexual harassment that allegedly occurred prior to August 14, 2020, The University will apply the former University Policy 154 Title IX statute and the Title IX regulations in place at the time that the alleged sexual harassment occurred.

Commitment & Response

Retaliation against individuals who report or may report any of this misconduct is also strictly prohibited. When allegations of sex-based discrimination, non-sex-based discrimination, sexual harassment (including sexual assault, domestic violence, dating violence, and stalking), non-sex-based harassment, or retaliation are reported to the University, the Office of Equal Opportunity and Title IX will take prompt action to review and resolve the reported concern including: explaining the availability of supportive measures and resources; providing information about reporting options; evaluating and investigating the allegations; providing an equitable grievance process to address the allegations and prevent recurrence through appropriate sanctions/corrective action/discipline. The Office of Equal Opportunity & Title IX also provides preventative education for students and employees.
